Terms of Service

Welcome to Web-3D.Tech, operated by JUYATU ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our 360° video platform and services. Please read these Terms carefully before using our services.

By accessing or using our platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

1. Service Description

Web-3D.Tech provides a technical platform for uploading, processing, and streaming 360° videos. We do not create, edit, or curate your content and we do not provide any editorial or publishing services. Our role is limited to providing the tools and infrastructure that allow you to upload your videos, convert them to streaming formats, and deliver them to viewers via URLs that you control.

Our services include:

  • Video Upload: Upload 360° video files in various formats
  • HLS Conversion: Automatic conversion of videos to HLS (HTTP Live Streaming) format for optimal streaming performance
  • Video Streaming: Delivery of converted videos through our streaming infrastructure
  • 360° Video Player: Built-in player for immersive 360° video playback with interactive controls
  • Content Management: Tools to organize, manage, and share your videos
  • Subscription Services: Paid plans with different features and limits
  • Credit System: Pay-as-you-go credits for video processing

2. Account Registration and Responsibility

2.1 Account Creation

To use our services, you must create an account by providing accurate, current, and complete information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Ensuring your account information remains accurate and up-to-date

2.2 Account Eligibility

You must be at least 13 years old (or the age of majority in your jurisdiction) to create an account. By creating an account, you represent and warrant that you meet this age requirement.

3. Acceptable Use Policy

You agree not to use our services to:

  • Upload, share, or distribute any content that is illegal, harmful, threatening, abusive, or violates any laws
  • Upload content that infringes on intellectual property rights, including copyrights, trademarks, or patents
  • Upload content that contains malware, viruses, or other harmful code
  • Upload content that is defamatory, libelous, or invades privacy
  • Upload content that promotes or depicts extreme or gratuitous violence, self-harm, terrorism, or incitement to violence
  • Upload content that promotes hate speech or discrimination against any individual or group based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or any other protected characteristic
  • Upload content that contains explicit sexual material, pornography, sexual exploitation, or content involving minors, or that would otherwise be considered illegal or obscene in any applicable jurisdiction
  • Impersonate any person or entity or falsely represent your affiliation
  • Interfere with or disrupt the services or servers connected to the services
  • Attempt to gain unauthorized access to any part of the platform
  • Use automated systems (bots, scrapers) to access the services without permission
  • Resell or redistribute our services without authorization
  • Violate any applicable local, state, national, or international law

We reserve the right, at our sole discretion and without prior notice, to remove or disable access to any content that we believe may violate these Terms or applicable laws, and to suspend or terminate accounts that engage in prohibited activities. We are not obligated to monitor all content, but we may review content and cooperate with law enforcement or other authorities where required by law.

4. Content Ownership and License

4.1 Your Content

You retain all ownership rights to the videos and content you upload to our platform. By uploading content, you grant us a limited, non-exclusive, worldwide, royalty-free license to:

  • Store, process, and convert your videos to provide our services
  • Stream and deliver your videos to viewers as you configure
  • Display thumbnails and metadata for your videos
  • Use your content for technical purposes necessary to operate the platform

This license terminates when you delete your content or account, except for backups and cached copies that may persist for a reasonable period.

4.2 Public Content

If you choose to make your videos public, you understand that they may be accessible to anyone with the video link and may appear in our showcase or be discoverable through search. You are solely responsible for the content you make public.

4.3 Platform Rights

All rights, title, and interest in and to the platform, including its software, design, features, and functionality, remain the exclusive property of JUYATU, Web-3D.Tech and its licensors.

4.4 User Responsibility for Content and Compliance

You are solely responsible for all videos and other content you upload, process, or distribute through our platform, including ensuring that such content complies with all applicable laws, regulations, and third-party rights (such as copyright, privacy, and publicity rights) in all jurisdictions where the content is made available.

You acknowledge that we do not review or approve your content before it is processed or made available, and that we do not assume any responsibility or liability for your content or for how you choose to share or embed the streaming URLs we provide. You agree that you will not represent to any third party that Web-3D.Tech is the creator, publisher, or producer of your content.

5. Paid Services and Billing

5.1 Subscriptions

We offer various subscription plans with different features, limits, and pricing. By subscribing, you agree to:

  • Pay the subscription fee in advance for the billing period
  • Automatic renewal unless you cancel before the renewal date
  • Price changes with advance notice (existing subscriptions may be grandfathered)
  • No refunds for partial billing periods after cancellation

5.2 Credit Packages

Credits are used for video processing and conversion. Credits:

  • Are purchased in advance and added to your account
  • Are consumed when videos are processed
  • Do not expire unless otherwise stated
  • Are non-refundable except as required by law

5.3 Payment Processing

Payments are processed by third-party payment providers. You agree to provide accurate payment information and authorize us to charge your payment method for all fees. You are responsible for any taxes applicable to your purchases.

5.4 Refunds

If technical problems prevent or unreasonably delay delivery of the Product, your exclusive and sole remedy is either replacement of the Product or refund of the price paid, as determined by JUYATU.

You must contact us within 14 days after completing the purchase to be eligible for a refund. All refund requests received after 14 days from the date of the Transaction will not be processed.

For subscription services, there are no refunds on unused subscription periods. Subscription fees are non-refundable after the service period begins.

For credit purchases, credits are non-refundable once credits are added to your account.

We reserve the right to review your account and usage records. If we reasonably believe that a refund request is fraudulent, made in bad faith, or associated with abuse or excessive use of the services, we may decline the refund request.

6. Service Availability and Interruptions

We strive to provide reliable and continuous service, but we do not guarantee uninterrupted or error-free operation. Service may be interrupted due to:

  • Scheduled maintenance and updates
  • Technical issues or failures
  • Third-party service outages
  • Force majeure events
  • Security concerns or attacks

We reserve the right to modify, suspend, or discontinue any part of our services at any time, with or without notice.

7. Video Processing and Quality

7.1 Processing Time

Video conversion times vary based on file size, resolution, and system load. We do not guarantee specific processing times. Large videos or high resolutions may take longer to process.

7.2 Quality and Format

We process videos to the best of our ability, but we do not guarantee:

  • Perfect conversion quality for all input formats
  • Compatibility with all source video formats
  • Preservation of all metadata or features
  • Specific output quality or bitrate

7.3 Failed Processing

If video processing fails due to our error, we will attempt to reprocess or provide credits for retry. If processing fails due to unsupported formats or corrupted source files, credits may not be refunded.

8. Termination

8.1 Termination by You

You may terminate your account at any time by deleting your account through your account settings or by contacting us. Upon termination:

  • Your access to the services will cease
  • Your content will be deleted (subject to backup retention periods)
  • Active subscriptions will continue until the end of the billing period
  • Unused credits may be forfeited unless required by law

8.2 Termination by Us

We may suspend or terminate your account immediately if you:

  • Violate these Terms or our policies
  • Engage in fraudulent or illegal activities
  • Fail to pay required fees
  • Abuse or misuse our services
  • Pose a security risk to the platform or other users

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We disclaim all warranties, including but not limited to:

  • Merchantability, fitness for a particular purpose, or non-infringement
  • Uninterrupted, secure, or error-free operation
  • Accuracy, completeness, or reliability of the services
  • That defects will be corrected
  • That the services will meet your requirements

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, data, or use
  • Business interruption
  • Loss of goodwill
  • Cost of substitute services
  • Damages resulting from use or inability to use the services

Our total liability for any claims arising from or related to the services shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless JUYATU, Web-3D.Tech and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

  • Your use of the services
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Content you upload or share

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to conflict of law principles.

Any disputes arising from or related to these Terms or the services shall be resolved through good faith negotiation. If negotiation fails, disputes may be resolved through binding arbitration or in the appropriate courts, as determined by applicable law.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the services after changes become effective constitutes acceptance of the modified Terms.

If you do not agree to the modified Terms, you must stop using the services and may terminate your account.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and JUYATU (Web-3D.Tech) regarding the use of our services.

By using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
